Bellare GIS provides geospatial technology services, including but not limited to GIS consultancy, spatial data analysis, remote sensing, thematic mapping, urban planning, environmental analysis, and custom GIS solutions. Our Services may include:

• Consultation on geospatial technology implementation
• Creation and analysis of spatial data
• Development of custom GIS applications
• Training on GIS technologies and methodologies
• Research and development in the field of geospatial technology
• Access to resources, publications, and educational content

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our Services.

You may access and use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• You own or have the necessary rights to use and authorize us to use all IP Rights to your User Content
• Your User Content does not violate any rights of any other person or entity
• Your User Content complies with these Terms and all applicable laws

We reserve the right to remove any User Content that, in our sole judgment, violates these Terms or may be offensive, illegal, or violate the rights of any third party.

Unless otherwise indicated, our Services and all content and materials available through our Services, including our logos, designs, text, graphics, images, and software, are the property of Bellare GIS or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our Services for your personal or internal business purposes. This license does not include:

• Any resale or commercial use of our Services or content
• Any collection and use of product listings, descriptions, or prices
• Any derivative use of our Services or content
• Any downloading or copying of account information for the benefit of another merchant
• Any use of data mining, robots, or similar data gathering and extraction tools

All rights not expressly granted to you in these Terms are reserved and retained by Bellare GIS or our licensors.

For Services that require payment, the following terms apply:

• All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
• You agree to provide accurate and complete billing information including legal name, address, telephone number, and payment method details.
• If payment is not received by the due date, we may terminate your access to the Services.
• All fees paid are non-refundable unless otherwise specified in a separate agreement.
• We reserve the right to change our fees at any time, upon notice to you.

Specific payment terms may be provided separately when you engage our professional services.

To the maximum extent permitted by law, in no event shall Bellare GIS, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our Services
• Any conduct or content of any third party on our Services
• Any content obtained from our Services
• Unauthorized access, use, or alteration of your transmissions or content
• Any errors or omissions in the technical operation of our Services

In no event shall our aggregate liability for all claims relating to the Services exceed the greater of:

• The amount paid by you to Bellare GIS for the Services in the 12 months before the event giving rise to the liability, or
• INR 10,000 (Ten Thousand Indian Rupees)

The limitations of damages set forth above are fundamental elements of the basis of the bargain between Bellare GIS and you.

Your use of our Services is at your sole risk. Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Bellare GIS expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Bellare GIS makes no warranty that:

• Our Services will meet your requirements
• Our Services will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of our Services will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained by you through our Services will meet your expectations
• Any errors in the Services will be corrected

Any material downloaded or otherwise obtained through the use of our Services is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

You agree to defend, indemnify, and hold harmless Bellare GIS, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to our Services
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your User Content caused damage to a third party

This defense and indemnification obligation will survive these Terms and your use of our Services.

We may terminate or suspend your access to all or part of our Services, with or without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms, is in violation of any applicable law, or is harmful to the interests of other users or us.

Upon termination:

• Your right to use our Services will immediately cease
• We may delete or archive any content or data you have provided
• All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date at the top of these Terms.

Your continued use of our Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using our Services.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or your use of our Services shall be exclusively brought in the courts located in Dakshina Kannada District, Karnataka, India, and you hereby consent to the personal jurisdiction and venue of such courts.
